Have you ever wondered if there will come the day that you gonna get sued by a customer?
Well, howdy, howdy, howdy.
I’m glad to be here and I hope you are too.
I’ve got something important to talk about today, and if you’re a food vendor—hot dogs, funnel cakes, cookies, kettle corn, lemonade—this absolutely applies to you.
And yeah… it might make you a little nervous.
Because the question is:
Is this hot dog vendor gonna get sued?
Let me tell you what happened.
The Incident That Made a Vendor Worry She’d Get Sued

I had a vendor from our Vendors United group reach out to me after an event.
She had her cart set up properly.
Cart in the middle.
About a two-foot gap.
Then coolers lined up beside it.

Plenty of space—three to four feet between customers and her hot water.
She’s talking with a customer.
She’s dropping in a fresh batch of frozen meat.
And boom—more hot water splashes than she expected.
One tiny drop arcs over and lands on a lady’s arm.
The lady says, “Ow!” and grabs her arm.
Now…
It wasn’t a pot dumped on someone.
Surely it wasn’t negligence.
It wasn’t chaos.
It was a fluke.
But the vendor’s first thought?
“Oh my God… am I gonna get sued?”
Could You Get Sued Over Something Small?
Here’s the honest truth.
You can get sued for anything.
You can get sued if:
- Someone burns their hand.
- A kid chokes.
- Someone claims they broke a tooth on a cookie shell.
- A customer says your food made them sick.
- A splash of water goes further than physics should allow.
Does that mean you’ll lose?
No.
Does it mean it’ll be valid?
Not necessarily.
But can someone try?
Absolutely.
And that’s why we carry insurance.
Why Liability Insurance Matters (Even for “Small” Incidents)

The vendor in this story?
She had liability insurance already in place.
And that’s huge.
Not because she expected a lawsuit.
But because she was protected.
She reported the situation properly—not as a claim—but as an incident.
Helpful: Hot Dog Vendor Health Insurance
That’s important.
A lot of insurance policies have fine print that says:
“If you didn’t report the incident when it happened, we can deny coverage later.”
And guess what?
Insurance companies have very expensive lawyers who write that fine print.
So when something happens—even small—you report it.
Do not panic.
You don’t admit fault.
Document it.
And notify insurance.
That’s it.
You Don’t Want to Get Sued Alone
Here’s the real deal.
You want the insurance company’s lawyers involved.
Not because you expect disaster.
But because they:
- Know how to de-escalate nonsense.
- Know how to handle exaggerated claims.
- Know how to shut down opportunistic lawsuits.
You want someone with deeper pockets standing next to you.
Not you alone.
Real Examples: People Sue Over the Weirdest Stuff
Let me tell you something else.
I had a vendor who sold cookies.
A customer claimed a pecan shell cracked her tooth.
She sued.
Now, was it legit?
Who knows.
But because the vendor had insurance?
It wasn’t devastating.
I had someone once walk up to my cart, look at it, say:
“That looks hot.”
Then touch it.
With three fingers.
And burn themselves.
People do unpredictable things.
And when they do, sometimes they blame you.
Get Sued or Get Protected? Your Choice.
You can’t build a 50-foot barrier around your cart.
And for sure you can’t make customers wear hazmat suits.
You can’t eliminate all risk.
But you can:
- Carry proper food vendor liability insurance.
- Add venues as additional insured (loss payee) on the fly.
- Document incidents immediately.
- Stay professional and calm.
And here’s another benefit:
A lot of schools, festivals, and event organizers won’t even hire you unless you’re insured.
So insurance doesn’t just protect you.
It helps you get gigs.

Now listen carefully.
This stuff isn’t common.
I don’t constantly hear about vendors getting sued.
It’s rare.
But “rare” doesn’t mean “never.”
And the vendor who reached out to me?
She handled it well.
Had insurance.
She reported it.
And stayed calm.
And she kept vending.
That’s what professionals do.
Protect Yourself Before Something Happens
If you feed people in any capacity:
- Hot dogs
- Lemonade
- Funnel cakes
- Cottage food baking
- Kettle corn
- Dirty sodas
- Anything edible
You need liability insurance.
It’s not expensive.
It’s not complicated.
And it can save your entire business.
